The 2010 Equality Act replaced the Disability Equality Duty, which came into force in December 2006 and obligated all public bodies – including Higher Education Institutions– to pay ’due regard‘ to the promotion of equality for disabled people in every area of their work. The DED required all public authorities to do what they can to:

  • promote equality of opportunity
  • eliminate unlawful disability discrimination
  • eliminate disability related harassment
  • promote positive attitudes towards disabled people
  • encourage participation by disabled people in public life
  • take account of people’s disabilities even if this means treating them more favourably than others.

The Equality Act came into force in October 2010 and brought together nine separate pieces of legislation into one single Act. 

This was intended to simplify the law and strengthen it to help tackle discrimination and inequality.Universities like Queen Mary are still required to ensure that disabled staff and students are not discriminated against; we are also required to involve disabled students and staff when making decisions, e.g. when designing the content of new courses
